New Delhi: A complaint accusing Delhi Chief Minister Atishi of violating the model code of conduct (MCC) was filed with the District Election Officer, prompting an FIR to be registered at the Govindpuri Police Station. The FIR was filed after the returning officer of the District Election Office (DEO) forwarded the complaint and directed the local police to lodge the FIR.
The FIR dated 11 January, a copy of which is with ThePrint, has been lodged under Bharatiya Nyaya Sanhita section 223 (a) (punishment for disobeying orders given by public servants). The complaint was received on 8 January with allegations against Atishi over violating the MCC and using government vehicles for political purposes. It also mentions that the complaint is against executive engineer Sanjay Kumar.
The complaint filed by the Returning Officer to the Assistant Commissioner of Police, Kalkaji, cites a letter from the General Administration Department of the Government of the National Capital Territory of Delhi (GNCTD), dated 7 January. The letter specifies a complete and absolute ban on the use of official vehicles for campaigning, electioneering, or any election-related travel during elections.
“The executive engineer is an accused in the case. Delhi CM Atishi has not been booked in the case. The complaint from Govindpuri police station was forwarded to the DEO. The DEO conducted an inquiry and the FIR has been lodged based on their complaint,” a senior police officer told ThePrint on the condition of anonymity.

“The FIR was lodged on the DEO’s complaint,” the officer said.
The original complaint was filed in the Govindpuri Police Station by D.S. Duggal, Vice-President of the South Delhi BJP, which was forwarded to the DEO. Duggal alleged that on 7 January, around 2.30 pm, following the announcement of the MCC, CM Atishi “misused” a government vehicle to distribute materials for her own election office.
“I and the residents of the area protested against this. I tried to highlight this issue through videos and in the media. In the video her personal assistant is also seen,” the complaint said.
